Growing concerns keep raising about the Energy Charter Treaty and the risk it puts on the EU’s achievement of its climate commitments. While this idea is increasingly shared, the modernization process of the ECT, that many EU governments see as an opportunity to make the ECT greener, is at risk of dragging on for a very long time. The option of withdrawal from the ECT deserves therefore to be carefully considered. While the so-called “sunset clause” would extend the protection of existing energy investments for another 20 years after withdrawal, solutions exist to neutralize the effects of the sunset clause. Those will be discussed from a political and legal point of view with experts.
